Acceptable Use Policy#

Introduction#

This Acceptable Use Policy ("Policy") governs your use of MeritBoost's services, software, and platform (collectively, the "Services"). By accessing or using our Services, you agree to comply with this Policy. This Policy is incorporated into and subject to our Terms of Service.

Prohibited Uses#

When using our Services, you agree not to:

  1. Violate Laws or Regulations: Use the Services in any manner that violates applicable local, state, national, or international law or regulation.

  2. Infringe Intellectual Property Rights: Violate the intellectual property rights of MeritBoost or any third party, including copyright, trademark, patent, trade secret, or other proprietary rights.

  3. Unauthorized Access: Attempt to gain unauthorized access to any portion of the Services, other accounts, computer systems, or networks connected to the Services.

  4. Security Testing: Conduct security testing, vulnerability scanning, or penetration testing of the Services without prior written permission from MeritBoost.

  5. Malicious Code: Upload, post, or otherwise transmit any malicious code, files, or programs designed to interrupt, destroy, or limit the functionality of the Services.

  6. Disrupt Service: Interfere with or disrupt the Services or servers or networks connected to the Services.

  7. Impersonation: Impersonate any person or entity, falsely state or otherwise misrepresent your affiliation with a person or entity, or create a false identity.

  8. Harassment: Use the Services to harass, abuse, or harm another person or entity, or attempt to do so.

  9. Data Mining: Engage in data mining, scraping, crawling, or other data extraction methods on the Services unless expressly permitted.

  10. Circumvent Measures: Circumvent or attempt to circumvent any security, authentication, or access controls implemented in the Services.

Employee Data Usage#

As our Services primarily process employee performance and skill data, customers and users must:

  1. Respect Privacy: Respect the privacy and confidentiality of employee data accessible through the Services.

  2. Appropriate Use: Use employee performance data, skill assessments, and appraisals only for legitimate business purposes related to workforce management, skills development, and performance evaluation.

  3. Confidentiality: Maintain the confidentiality of endorsements and appraisals as outlined in our Privacy Policy.

  4. Data Subject Rights: Respect and facilitate the exercise of data subject rights in accordance with applicable data protection laws and our Privacy Policy.

System Integrity#

To maintain system integrity, you agree not to:

  1. Excessive Usage: Place an unreasonable or disproportionately large load on our infrastructure.

  2. Monitoring: Use any device, software, or routine that interferes with the proper working of the Services.

  3. Reverse Engineering: Decompile, disassemble, or otherwise attempt to discover the source code of the Services or any part thereof, except as expressly permitted by applicable law.

  4. Modification: Modify, adapt, or hack the Services or modify another website to falsely imply that it is associated with the Services.

Enforcement#

MeritBoost reserves the right to:

  1. Investigate: Investigate potential violations of this Policy.

  2. Remove Content: Remove any content that violates this Policy or is otherwise objectionable.

  3. Suspend Access: Temporarily or permanently suspend access to the Services for users who violate this Policy.

  4. Terminate Service: Terminate service to customers who repeatedly violate this Policy or whose users repeatedly violate this Policy.

  5. Report Violations: Report violations to law enforcement authorities as appropriate.

Changes to this Policy#

MeritBoost may update this Policy from time to time. We will notify customers of any changes by posting the new Policy on our website and, if the changes are significant, we will provide a more prominent notice.
